This Privacy Notice (hereinafter the "Notice") sets forth the terms and conditions under which El Viajero Hostels SAS, identified with NIT 900.375.454 - 4 and residing at B. SAN DIEGO CALLE DE LOS SIETE INFANTES NO. 9 - 45 in Cartagena, Bolivar (hereinafter "VIAJERO"), will process your personal data.

Treatment and purpose

The treatment that includes the collection, storage, use, circulation of personal data, which will be carried out by the VIAJERO with the personal information will be the following:

  1. To allow the participation of the Holders in marketing and promotional activities carried out by VIAJERO, to evaluate our hostels;
  2. VIAJERO uses the information for marketing purposes, such as to send you our newsletter or other promotional emails. You may opt out of receiving marketing emails from us by following the unsubscribe instructions included in these communications.
  3. Control access to VIAJERO's offices and establish security measures, including the establishment of video surveillance areas;
  4. To respond to queries, petitions, complaints and claims made by the Data Controllers and control bodies and to transmit the Personal Data to other authorities that by virtue of the applicable law must receive the Personal Data;
  5. To eventually contact, via e-mail, or by any other means, natural persons with whom it has or has had a relationship, such as, but not limited to, employees and their relatives, shareholders, consumers, customers, clients, distributors, suppliers, creditors and debtors, for the aforementioned purposes.
  6. Transfer the information collected to different areas of VIAJERO and its related companies in Colombia and abroad when necessary for the development of its operations (portfolio collection and administrative collections, treasury, accounting, among others);
  7. For the attention of judicial or administrative requirements and compliance with judicial or legal mandates;
  8. Register your personal data in VIAJERO's information systems and in its commercial and operational databases;
  9. Any other activity of a similar nature to those described above that are necessary to develop the corporate purpose of VIAJERO.

Rights of the holder

As the owner of your personal data you have the right to:

  1. Access free of charge to the data provided that have been subject to processing.
  2. Know, update and rectify your information regarding partial, inaccurate, incomplete, incomplete, fractioned, misleading, or those whose treatment is prohibited or has not been authorized.
  3. Request proof of the authorization granted.
  4. To file complaints before the Superintendence of Industry and Commerce (SIC) for violations of the provisions of the regulations in force.
  5. To revoke the authorization and/or request the deletion of the data, provided that there is no legal or contractual duty that prevents their deletion. (vi) Refrain from answering questions about sensitive data.
  6. Responses concerning sensitive data or data on children and adolescents will be optional.

LEGAL NOTICE VIAJERO HOSTEL


1. RIGHT OF WITHDRAWAL IN ELECTRONIC COMMERCE:


The Consumer Statute, in Article 47, establishes that:

"In all contracts for the sale of goods and provision of services through financing systems granted by the producer or provider, timeshare sales, or sales using non-traditional or remote methods, where the nature of the goods or services does not require consumption or execution before five (5) days, the consumer shall have the right of withdrawal. If the consumer exercises the right of withdrawal, the contract shall be terminated, and the amount paid by the consumer must be refunded. The consumer must return the product to the producer or provider through the same means and in the same condition in which it was received. The costs of transportation and other expenses related to the return of the goods shall be borne by the consumer. The maximum period to exercise the right of withdrawal is five (5) business days from the delivery of the goods or the execution of the contract in the case of service provision."

In this regard, please note that when booking our services through https://viajerohostels.com or our reservations call center, you may exercise the right of withdrawal within five (5) business days from the purchase confirmation. The withdrawal right cannot be exercised if the service has already commenced or is scheduled to take place within five (5) days of purchase. If the withdrawal is applicable, Viajero will refund 100% of the amount paid within a maximum of 30 calendar days, in accordance with Article 48 of the same statute.

 

2. REVERSAL OF PAYMENT:


According to Article 51 of the Consumer Statute, there must also be an option for payment reversal in electronic commerce and call center sales. This applies when a payment is made through electronic means and one of the following situations occurs:

Fraud: The consumer's electronic payment methods are used fraudulently.
Unauthorized transaction: Duplicate charge or an unauthorized purchase (e.g., a minor accidentally making a purchase on a parent’s tablet, although this case is debatable).
Product or service not received: The payment is successfully processed, but no confirmation of the service is issued.
In this regard, when booking our services through https://viajerohostels.com or through any of our official reservation phone numbers using a credit or debit card, or any other electronic payment method issued by a financial institution domiciled in Colombia, you may request a payment reversal in the event of fraud, unauthorized transactions, or non-receipt of the acquired service.

 

3. LIABILITY NOTICE FOR SERVICES AND ACTIVITIES PROVIDED BY THIRD PARTIES


VIAJERO HOSTEL S.A.S, in its commitment to providing unique experiences to its guests, facilitates access to various activities and services provided by third parties, both within and outside our premises.

VIAJERO HOSTEL S.A.S assumes no responsibility for incidents, damages, losses, accidents, or any other situations that may arise as a result of services and activities organized and operated by independent providers, outside the management and control of VIAJERO HOSTEL S.A.S.

By contracting or participating in these activities, the guest agrees that any matters related to the quality, safety, fulfillment, or performance of such services must be addressed directly with the respective provider.

For your peace of mind, we recommend checking the conditions, cancellation policies, and safety measures with the provider before booking any activity.

4. DISCLAIMER OF LIABILITY AND RISK ACCEPTANCE


At VIAJERO HOSTEL S.A.S, we strive to provide unforgettable experiences for our guests, including various activities both within and outside our facilities. However, it is important that visitors are informed about the inherent risks of such activities and the conditions under which they are offered.

1. At our locations, you can participate in activities organized directly by us, such as:
Use of swimming pools and recreational areas.
Sports and outdoor activities.
Tourist walks and excursions outside our premises.
Other recreational and cultural experiences.


2. Risk Acceptance: By participating in any of these activities, the guest acknowledges that they:
Understand the possible risks involved, including injuries, accidents, or personal losses.
Assume responsibility for their own safety and well-being during the activity.
Will follow all safety instructions and regulations provided by the hostel staff.
Will inform the hostel about any medical condition or restriction that may affect their participation.


3. Disclaimer of Liability: VIAJERO HOSTEL S.A.S is not responsible for:
Accidents or injuries resulting from voluntary participation in activities.
Loss or damage of personal belongings during activities.
External factors beyond our control (e.g., weather conditions, third-party involvement, etc.).
By booking a stay and/or participating in our activities, the guest acknowledges this notice and releases VIAJERO HOSTEL S.A.S from any claims arising from their participation in the offered activities.

 

LODGING AGREEMENT


PURPOSE:
Under this contract, VIAJERO will provide the GUEST with lodging services for the number of nights requested, as well as any additional services the GUEST requests.

PRICE:
For the provision of services, the GUEST shall pay the nightly rate stated in their reservation, including applicable taxes, as well as any additional charges incurred during their stay. These charges will be detailed in the accompanying invoice. In cases of tax-exempt or excluded transactions, the invoice will reflect the tariff without taxes.

SCOPE OF SERVICES:
(i) Service provision is subject to availability and the physical stock of supplies, goods, facilities, or spaces.

RIGHTS AND OBLIGATIONS OF VIAJERO:
(i) VIAJERO may reassign rooms at any time, as long as the new room has equal or better conditions or due to force majeure or unforeseen circumstances.
(ii) Upon check-in, VIAJERO may require a credit card to guarantee lodging costs and other charges. The GUEST authorizes VIAJERO to charge the card for services.
(iii) VIAJERO is only liable for items officially entrusted to them for safekeeping. VIAJERO is not responsible for lost valuables left in rooms, as safety deposit boxes are available for securing money and valuable items.

RIGHTS AND OBLIGATIONS OF THE GUEST:
(i) Check-in time is 3:00 PM, and check-out is at 11:00 AM. Partial use of the day incurs the full rate.
(ii) The GUEST must comply with VIAJERO HOSTELS’ policies and behave in accordance with public order laws.
(iii) Unregistered guests must register and pay the applicable accommodation rate.
(iv) The GUEST is responsible for any damage to facilities or property caused by them or their companions.
(v) The GUEST assumes responsibility for supervising minors accompanying them during their stay.

 

CANCELLATION POLICIES:

Refundable rates and packages: Free modification or cancellation up to 24 hours before arrival. Failure to notify results in a one-night charge.
Flexible non-refundable rates: One modification is allowed up to 24 hours before check-in. No-shows or second modifications will be charged in full.
Non-refundable rates: No refunds, modifications, or cancellations.


ESCNNA WARNING:

In compliance with Law 679 of 2001, VIAJERO HOSTEL warns guests that the commercial sexual exploitation of children and adolescents is punishable in Colombia with prison sentences ranging from 14 to 25 years. VIAJERO will report any suspected ESCNNA-related activity to authorities.
